पारिवारिक विवाद निपटाने का सुलभ तरीका है लोक अदालत —न्यायाधिपति, श्री एम. एम. श्रीवास्तव —कुल 2,876 मामलों का किया निस्तारण
जयपुर, 14 सितम्बर। प्रदेश में राष्ट्रीय लोक अदालत के माध्यम से आयोजित विशेष लोक अदालत राजीनामा योग्य सभी मामलों के साथ पारिवारिक न्यायालयों में चल रहे प्रकरणों को निपटाने का सुलभ तरीका बनकर उभर रहा है। राजस्थान राज्य विधिक सेवा प्राधिकारण के सदस्य सचिव श्री प्रमिल कुमार माथुर ने बताया कि सम्पूर्ण राजस्थान में पारिवारिक प्रकरणों से संबंधित जिला न्यायालय स्तर के कुल 168 न्यायालय कार्यरत हैं, जिनमें कुल 74,345 प्रकरण लम्बित है। वहीं गत राष्ट्रीय लोक अदालत में पक्षकारों के मध्य समझाईश एवं सुलह कराई जाकर कुल 2,876 मामलों का निस्तारण किया गया है।
न्यायाधिपति श्री एम. एम. श्रीवास्तव ने राष्ट्रीय लोक अदालत की सफलता के लिए रालसा, जिला विधिक सेवा प्राधिकरण व तालुका विधिक सेवा समितियों के अधिकारीगण की भूरी-भूरी प्रशंसा की। उन्होंने मार्गदर्शन दिया कि कुछ ऐसे मामले होते हैं जिनका निस्तारित होना किसी भी लोक अदालत के लिए एक सकारात्मक संकेत है। वैवाहिक विवाद के मामलों में राष्ट्रीय लोक अदालत द्वारा उनका समझौता हुआ। इसी तरह भाईयों या परिवार के सदस्यों के मध्य पारिवारिक विवाद जिसमें जायदाद के बटवारे को लेकर पक्षकारान वर्षों से मुकदमेबाजी में फंसे हो, ऐसे प्रकरणों का लोक अदालत के प्रयासों से निपटारा होता है तो न केवल उन्हें मानसिक तनाव से मुक्ति मिलती है, बल्कि भाईचारे से उनका विवाद समाप्त होकर वे सुखमय जीवन व्यतीत करने के लिए अग्रसर होते हैं।
उन्होंने सुझाव दिया कि मोटरयान दुर्घटना दावे के प्रकरणों के अधिकाधिक निस्तारण से दुर्घटना से हुई मृत्यु के परिणामस्वरूप जो परिवार आहत होते हैं उन्हें यदि लोक अदालत के प्रयासों से तुरन्त प्रतिकर मिलता है तो यह उनके परिवार पर आई असामयिक आपदा/क्षति को कम करने का एक सर्वोत्तम उपाय है।
भरतपुर जिले की महिला व उसके दो बच्चों को मिला 4000 रूपये प्रतिमाह भरण पोषण भत्ता—
जिला विधिक सेवा प्राधिकरण, भरतपुर का एक मामला जिसमें पति-पत्नी का विवाह 27 वर्ष पूर्व हुआ था और शादी के लगभग 18 वर्ष बाद पति-पत्नी के मध्य मन—मुटाव होने के कारण पत्नी द्वारा न्यायाधीश, पारिवारिक न्यायालय, भरतपुर के समक्ष मुकदमा दर्ज कराया, जिसमें वर्ष 2016 में निर्णय दिया जिसमे महिला व उसके दो बच्चों के लिए 4000 रूपये प्रतिमाह भरण पोषण भत्ता तय हुआ था। उक्त विवाद को राष्ट्रीय लोक अदालत की बैच के समक्ष रैफर करवाया जाकर दोनों पक्षकारों के मध्य समझौता बात की गई और सुलह करवाई गई।
झालावाड़ में समझाईश कर दोनों पक्षों के मध्य राजीनामा कराया—
जिला विधिक सेवा प्राधिकरण, झालावाड़ में महिला द्वारा दहेज में 05 लाख रूपये की मांग कि शिकायत की गयी, जिस पर प्रार्थिया द्वारा भरण—पोषण राशि प्राप्त करने हेतु प्रकरण न्यायालय में दर्ज कराया था। उक्त मामले में पारिवारिक न्यायाधीश द्वारा दोनों पक्षों को पृथक-पृथक सुना और राजीनामे के लिए राष्ट्रीय लोक अदालत मैच में रेफर किया, जहां बैंच द्वारा दोनों पक्षों की काउंसलिंग करते हुए दाम्पत्य जीवन के महत्व एवं संतान के भविष्य के बारे में समझाईश कर दोनों पक्षों के मध्य राजीनामा कराया गया।
पारिवारिक न्यायालय, झालावाड के एक दूसरे मामले में सामने आया कि पति-पत्नी का विवाह सम्पन्न होकर एक पुत्र का जन्म हुआ तथा महिला ने परिजनों के उक्त व्यवहार से तंग आकर न्यायालय में परिवाद दर्ज कराया गया, जो कि काफी समय से लम्बित था। लोक अदालत के दौरान दोनों पक्षकारों के मध्य समझाईश करायी गई और राजीनामा कराया गया।
